First off, way to go, Rick! This is far from over, but it’s a heck of a good start. “Ouch” is right.
This is the (cream cheese!) icing on the cake.
Next, we have a comment from WOWNinja365 on my “The Plot Thickens” entry:
Wait a sec. Didn’t Nicky publish “Electrocuting the Clowns” in “A Library of Unknown Horrors”? By David “Doc” Byron, no less?
Why, yes, I think he did: http://www.lulu.com/product/hardcover/a-library-of-unknown-horrors/4834605
Hmm. That ties two Nitwits together, although I seriously doubt Nicky knew the story was stolen. Not that Nicky would ever pull an anthology over a little thing like a contributor plagiarizing a story (since it wasn’t his story that was stolen), but we can hope, can’t we? Lulu, on the other hand, might, especially since I believe Rick Moore already contacted them about his story being used in something else.
Iron Dave is going down.
You know, it’s like those targets at the carnival where you shoot one and another pops up. Yep, I’m on my way to lulu. Not going to waste time with the other guy.
By the way, did I tell you that an investigative reporter was done Iron Dave’s way digging into this story?
Make that “down” Iron Dave’s way!
Man! One of Nicky’s anthos might get pulled, and not due to something he did. (At least, not knowingly.)
That’s incredibly ironic. Nicky screams all the time about non-existent plagiarism and he’s published a plagiarized story.
Maybe even… two?

Just in case . . .
It’s Six Degrees of Separation, the Nicky Edition!
In a sidenote, you can now get Nicky as a result on Akinator: http://us.akinator.com/
On a completely unrelated note, I just learned that when I have you bookmarked just above Monty Python’s “Sit On My Face,” I must be observant with my clicking while drinking coffee.
Nicky and Iron Dave converge! http://shocklinesforum.yuku.com/reply/159178/t/New-on-line-horror-magazine-premiering-on-October-31st-2010.html#reply-159178
So amused that Nicky is so desperate to be published that he’ll go to a plagiarist for even the slight chance it’ll happen.
Matt deleted Beero’s comment in reply to Nicky, but I think he left the ones since then. It’s pretty obvious that Nicky didn’t bother reading the comments. I’m also reasonably sure Nicky doesn’t know the story he published with David “Doc” Byron’s byline is the one Iron Dave stole from Rick Moore. Thing is, if he knew, he’d probably get it wrong, and accuse Rick of doing the stealing.
I agree, Rusty. That is why I advised Rick to go directly to lulu about the situation instead of trying to deal with Nicky directly.
Nicky has too many short circuits in the logic department to count on his dealing with anything rationally.
As much as Nicky yammers on about his hatred for plagiarism, in this particular case, I think his brain would stop functioning as soon as he realized his book sales were in danger. Not that he ever sold more than a handful of copies to anyone but himself, but still, that’s the way his cognitive processes work.
I am so impressed by everyone who’s been part of putting this together! This is the kind of thing where the Internet shines.
We’re trying, Jupiter.
B thoughful has created an awesome spreadsheet to track it all.
The first time Janrae had issues with Dave I made a point to comment in all of his questionable threads on Shocklines. He ignored any question that painted him in an unfavorable light, which of course was bad press for his non-press but still giving him the option to give his side of things. I wasn’t sure if he was ignoring me or if he was one of those forum posters that only log in to boards to shill their own crap and add nothing else.
He’s strictly “hit and run.”
Nicky just figured it out and posted on Shocklines blowing up at Byron. And of course, it’s all “poor me” instead of the authors who got screwed.
But he did say the title of the EG story: Blood Ties.
I’m a little confused. Nicky makes it sound like he’s going to let the story and book ride as is, and graciously allow Rick Moore to use the Doc Byron pseudonym.
Someone please tell me I’m wrong.
Bit hard to make out, in the first post it sounds as though he intends to keep the story but change the byline to the original author but then he talks about reworking the anthology, which suggests removing the story altogether. In short I don’t have a scooby about what he’ll actually do, not to mention that he has to work around his photoshoot schedule…
Nicky’s FB foolishness on the subject:
Sounds like he wants to edit the issue, but he no longer has the original files, so he’s hedging his bets with the “take over the pen name” idea. If he can’t re-edit the antho, bet you he’ll try to get away with just changing his Lulu content page to read “Rick Moore writing as Doc Byron.”
Should someone tell him he can simply download the pdf from Lulu and use Calibre to convert it to a text file?
And then, someone posts an Amazon link to her new book, and in typical Nicolette fashion, he makes it all about him.
Geez, Rick. As if you weren’t dealing with enough over all this. Now Nicky is knocking on your door. Yet another reason to throw everything at the Doc.
“Byron, I am going to have the original creator of the story you sent take over the pen name so it saves me all the trouble.”
Did Nicky just say that he’s going try to make Ferrel Rick Moore use Doc Byron as his new pen name, to save Nick the ‘trouble’ of having to do jack-shit about this?
Bwahahahahaha!
And now he’s talking about replacing the stories.

Also:
“I am glad I didn’t pay the asshole after learning about this”
Someone please screengrab Beeros friendly warning in Nickys new thread, before Matt goes and does anything very stupid. Beero is unable to perform such a task at this moment in time.
Wonder how Matt could possibly explain snipping that… lets find out.
Also….. what the lol

NICKY! BRAIN! GEARS! GRIND! HALT!
Love this nugget from there:
“Thankfully I cheated his ass out of getting paid, that was one I wouldn’t want to give him my money because that money goes to copies for my local guys. How does it feel that you screwed the other writers out of their copies, goddamned pigfucker.”
So I take it he WOULD have gotten around to getting the other writers their copies, but can’t now because he paid Byron, except that he cheated Byron out of that.
MAKES PERFECT SENSE!!! (lol)
Exactly, Jerrod. Nicky would have used the money he didn’t didn’t pay Byron — three years ago — to pay his other authors. Or something.
This is so very rich, Nicky going after one of the REALbad guys for once.

“We’re sorry, the item you requested is not available.”

=D
The paperback is still available.
From the this one on SL:
So, Nicky fights fraud with fraud.
What other weapons does he have? The body odor doesn’t work beyond a one- to two-mile radius, after all.
Tipped him off??? He just doesn’t want to admit he saw it here.
A stiff breeze will extend it out to about five, Jupiter, but still not far enough.
Mike: Exactly.
Who tipped him off, a friend?
A “friend” who was a PI offered to track me down for him, and he bragged online about how he had a personal army to go after me for him.
Needless to say the PI was LOL
I gave Nickolaus Pacione the heads up. He needed to know about David Boyer’s fraud. My gut tells me that Nickolaus was blind sided by this information, had no idea Boyer plagiarized the story. He has acted far quicker to this plagiarism than Lulu, since within a day he pulled the anthology in question…. Lulu is still “looking into the situation.”
…and it’s been a week of “looking into the situation.” All of Boyer’s books are still up for sale with Rick’s story.
B, Nicky hasn’t removed all the books he published with stories credited to David “Doc” Byron. He removed the hardcover of Unknown Horrors, but the paperback is still there as of this morning — after he claimed on SL that he took them all down.
How in the hell can he not know he put out two versions of the book? Even if he forgot, a quick scan of his storefront shows that it’s available. Even when he’s force-fed information, he still doesn’t get it.
Classic Nicky: While complaining about unprofessional behavior, admits he didn’t pay someone like he was supposed to for a story.
I am taking these down as I speak and looking for replacements for the asshole. I had no idea that he sent me a plagiarized story and I am taking each one down as I speak. I am going through each one and taking it down as I speak. Rusty Nail — go fuck yourself as far as my name is concerned, you should be berating the faggot Byron. I am trying to find out if he plagiarized a story in Issue 6. I already have my replacement for Issue 6 and he’s one of my best friends from college. I am working on these right now to take the links down. Ferrel — I will fix this. You have my word on this. I had no idea that it was plagiarized. If I’ve known, I wouldn’t have ran it.
Calm down, Nicky. In case you hadn’t noticed, I have three entries raking Doc Byron/Iron Dave over the coals. I know reading comprehension isn’t your strong suit, but haven’t you been paying any attention?
A friendly piece of advice to you, Nick: Stop bragging about not paying Doc Byron. Yes, he’s a plagarizing asshole who has caused you a great deal of stress. However, you just discovered this information days ago. The anthology in question is 3 years old. You’re revealing to the horror writing community that you have authors (plagarized or otherwise) on your anthology rosters who have been waiting for you to fufill your contractual obligations to them for a number of years. It’ bad business, and certainly not something I would be bragging about.
Stick a bullhorn down granny Paciones basement and yell your post at him…. very very slowly, using words with no more than four syllables, Shadowtron. Then he might perhaps get the message. After you’ve repeated it seventeen times, of course.
Classic Nicky: Cheating his contributors out of payment. (his own words)
Epic Nicky: Not only confessing to it afterwards, but actually bragging about it.
.
Actually… on second thought, I take that back, Shadowtron. He’s just too mentally subpar to ever get it… EVER.
Now that Matt locked the most important thread Shocklines has had in a long, long time and it’s doomed to fall off the map, I wanted to offer links to the Merchant’s Keep message board where folks are welcome to compile info and update.
I don’t wish to step on RN’s feet, of course, and I won’t be offended if this is deleted.
But that SL thread was pretty nice so in case there was need for a message board thread to use in addition to this and Rick’s blog:
There’s a plagiarism thread in our Writing General Discussion: http://merchantskeep.com/forum/viewtopic.php?f=18&t=786
And a better updated one in our Anything Goes section (which can get as crazy as people one, with the exception of threats and pornographic pics/videos): http://merchantskeep.com/forum/viewtopic.php?f=23&t=815
The farthest we can get this spread and stacked up with evidence the better.
Wait a minute- he locked it up? What in the world for?? And thanks, Jerrod, for the links to Merchants Keep!
Mostly because Pacione got busy attacking everyone on it and heaven forbid someone respond back. So Matt deleted the drama and locked the thread so it’ll sink into oblivion… and after all the good it’s done to alert people.
